Over the past week, there’s been a lot of discussion (and a new Indivisible guide!) dedicated to how we fight back once Trump reenters the White House.
But we’ve still got the White House and the Senate for another couple months. And there are actions we can take right now, while we still have that legislative power, to safeguard our democracy.
High on that list: Confirming every single judge we can before Trump takes office.
The calculus here is simple: The Senate can work around the clock in these final weeks to confirm the 29 pending nominations before them, or Trump gets to fill those vacancies with MAGA sycophants who will rubber-stamp his agenda.
We’re not going to pretend that the courts alone are going to save us from the dangers ahead. Trump has a 6-3 majority on the Supreme Court. JD Vance has expressed eagerness to trigger a constitutional crisis by ignoring court decisions.
We might not be able to block every element of Project 2025 via the courts. But we can use the judiciary to delay the implementation of as many attacks on our rights and communities as possible. An injunction here, a court order for further study and review there, and we can forestall the MAGA-fication of the federal government and the rollback of our freedoms as we claw back power via special elections, midterms, and beyond.
Cases do not make their way to the MAGA-dominated Supreme Court quickly, most of the time. So victories in lower courts will be a vital element of our strategy to delay, delay, delay.
If the Senate acts now, these judges will be on the bench before Trump enters office. And because these are lifetime appointments, they will be there long after Trump is gone.
Conversely, if the Senate does not pursue an all-out confirmation blitz, it will guarantee that these vacancies go to lawless, anti-choice judges who will lurch the courts further to the right for another generation.
Congress reconvened this week its final session before we lose our Senate majority. Tell your senators to stay in Washington and work the long hours required to confirm these judges and help protect our democracy.
