Pamela,

The House voted again this morning on H.R. 9495 -- the nonprofit killer bill -- and unfortunately, it passed. But that’s not the end of the story.

Quick reminder: We knew this was likely to happen. We said that in our email earlier this week, but we also said your calls were important anyway. And they were.

The goal here was not to stop a Republican-backed bill from getting through a Republican-controlled House. It was to unite Democrats against the bill to decrease the chance of it getting tacked onto some must-pass piece of legislation that’d make it extraordinarily hard to stop in the Senate.

And thanks to your calls, Democratic opposition to this bill was overwhelming. Last week, 52 Democrats voted YES. This time, only 15 did.

34 Democratic reps changed their minds and voted NO this time. Why? Because of your calls. Seriously, they told us:

Dark grey background featuring a statement from Rep. Gabe Vasquez (NM-02) reading: As we prepare for a turbulent 119th Congress, I am committed to representing my constituents and delivering for New Mexico. I have heard loud and clear from folks in my district and understand the concerns of my constituents, non-profit leaders and their staff. The incoming Administration's recent cabinet nominations give me little faith that this tool would be used as originally intended. Therefore, I have decided to vote against H.R. 9495 and will continue acting in our district's and nation's best interests.

First image: Blue background with white text featuring a statement from Rep. Haley Stevens (MI-11) reading: thank you to everyone who reached out to me about H.R. 9495 to express concerns about its potential damage to our precious nonprofit sector across Michigan's 11th District. While this vote easily passed the House, it was important to me to vote alongside the will of the thousands of constituents and stakeholders, many who I know well, and vote no. To everyone in our district please know your activism matters to me, your outreach matters, and your voices will always be heard by me. Let's keep going forward -- together.

A lot of you who made calls got similar emails from those offices saying how much those calls mattered.

So now, what’s next?

First off, if your representative voted no, please thank them (you can check here). In particular, we’re going to list the names and numbers of the 34 who changed their votes -- if your rep is on the list, PLEASE call them to thank them for listening to their constituents. We’re going to need them to keep standing strong against dangerous legislation like this when Trump takes office.

Second, if your representative voted yes AGAIN this time, they need to hear from you. Tell them you’re disappointed they’re willingly handing Trump the tools to undermine our democracy. We’ve got the list, with phone numbers, below, too.

And finally, we’ll keep you updated on the fight in the Senate. Democrats still control the chamber, so there’s NO reason this should end up on the president’s desk. The only fear remains that it could be included in must-pass legislation and Democrats will hold their nose and vote for it -- but we’re gonna fight to stop that from happening.

Thank you again for making these calls. We’ve rarely seen so many members of Congress turn around so quickly on a piece of legislation. That’s the power of grassroots activism, and it’s power we’re going to need to wield often in the months and years ahead.

Glad to have you fighting alongside us.

In solidarity,
Indivisible Team
